  1. Acceptance

This online store (hereinafter the Service) is available to any user for their personal use and is subject to the following terms and conditions: these Terms of Use and Contracting, our Legal Notice, our Privacy Policy, and Cookie Policy, which will always be available at the footer of the online site and must not be used for illegal purposes or in any way other than as contemplated by these terms.

  1. Service Description

Through the Service, Touch by Ally allows the purchase of cosmetics.

The contract between Touch by Ally and the buyer will be completed in Spanish.

The purchase process in the online store will be as follows:

â—Ź The product catalog is displayed on the website, divided into categories, so you can select the desired product.

â—Ź After selecting the product, it will be added to the shopping cart. At this point, you can continue shopping for more products or proceed to checkout.

â—Ź Once the selection is complete, you will need to fill in your personal details, billing address, delivery method, and payment method. You can also add discount codes and comments on your order.

● In the final step, a summary of the purchased items, payment method, delivery method, acceptance of the Service’s terms and conditions, and a button to confirm the purchase will be presented.

Furthermore, for legal reasons, we store the electronic documents that formalize the purchases in your profile. You can access these documents at any time through your account or by requesting them at: info@touch-by-ally.com

As a user of the Service, you agree to receive invoices for your purchases electronically. However, if requested, we will send the invoice in paper format to the address you provide. For more information, please contact us at: info@touch-by-ally.com

Additionally, during the purchase process, you will have the option to modify the quantity of items, change delivery and billing addresses, the payment method, and the delivery system. To do so, you must return to the corresponding button when possible and before the final acceptance of the purchase.

Once the purchase is completed, a confirmation email will be sent within a maximum of 24 hours to the address you provided. The email will include details of the purchased product, the amount, applicable taxes, shipping costs, payment method, delivery location and timeframe, and the applicable terms and conditions.

The Service may direct you to other websites via links. However, Touch by Ally does not control those sites or their content, which are subject to their own terms and conditions. Therefore, Touch by Ally is not responsible for the quality, truthfulness, or accuracy of those sites.

By using the Service, you declare that you are of legal age and have the necessary legal capacity to be bound by this agreement and to use the Service in accordance with its terms and conditions, which you fully understand and acknowledge.

The content and information of the Service (including, among others, data, text, sound, video, images, or computer code) and the infrastructure used to provide such content and information are the property of Touch by Ally or are authorized for use.

Additionally, no intellectual or industrial property rights over the website or any of its components are transferred to the client. The reproduction, transformation, distribution, public communication, making available, extraction, reuse, forwarding, or use of any kind, by any means or procedure, of any of them is expressly prohibited unless legally permitted or authorized by the holder of the corresponding rights.

For any other use of the Service’s content, you need our prior written consent.

6.2 User Content

As a user, you can contribute to the Service in various ways, such as by sending emails, submitting suggestions, or leaving comments on our blog (hereinafter "Content").

We may use that Content in various ways, such as displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting errors, creating derivative works, promoting it, and distributing it.

Therefore, the Content remains your property, but by submitting it, you grant Touch by Ally a global, non-exclusive, royalty-free, transferable, sublicensable license to use it until the content is withdrawn.

  1. Product Delivery and Availability

We deliver to the entire Spanish mainland and the entire European Economic Area.

The usual delivery times will range between five and ten days. In any case, the delivery date to your home may vary depending on the availability of the selected product, the origin warehouse, the shipping area, or specific circumstances of each order. It may also be affected by extraordinary issues with the carrier, weather conditions, or other similar delivery difficulties.

Please remember that deliveries are made every day of the week except Saturdays, Sundays, and public holidays.

If the purchased product is unavailable, the consumer will be informed via the website, and it will not be available for purchase. In that case, Touch by Ally will offer an alternative of equal or superior quality, with a corresponding price adjustment, which you can freely accept or reject.

  1. Prices and Taxes

The prices of the products offered on Touch by Ally are indicated in euros (€) and include the Value Added Tax (VAT) applicable at the time of purchase.

In any case, the transaction could be exempt from or not subject to VAT depending on your country of residence or the capacity in which you act. Therefore, in some cases, the final price of the order may differ from the one shown.

The price of the products will be as stipulated on the website at all times, except in the case of a manifest error. Although Touch by Ally strives to ensure that all prices displayed on the website are correct, errors may occur.

If an error in the price of the products ordered by the customer is discovered, Touch by Ally will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If Touch by Ally cannot contact the customer, the order will be considered canceled, and any amounts paid will be fully refunded.

Touch by Ally is not obliged to supply products (even if a shipping confirmation has been sent) if the error in the price is obvious and could reasonably have been recognized by the customer as an incorrect price.

Due to the peculiarities of online purchases, the price of the products listed on the website applies exclusively to purchases made there and does not necessarily correspond to the retail price of Touch by Ally’s physical stores or collaborators. Therefore, the price listed on the website is binding only for online purchases and in no way binds the physical stores of Touch by Ally or its partners.

Product prices may change, but (except as mentioned above), changes will not affect orders for which a shipping confirmation has already been sent.

Lastly, the buyer agrees to diligently and in good faith use the website, pay the established price, and be responsible for the accuracy of the data provided for the transaction.
